{"id":83904,"date":"2018-04-19T03:50:18","date_gmt":"2018-04-19T03:50:18","guid":{"rendered":"http:\/\/sierraexpressmedia.com\/?p=83904"},"modified":"2018-04-19T03:50:18","modified_gmt":"2018-04-19T03:50:18","slug":"reflections-on-4th-parliament-of-2nd-republic-of-sierra-leone","status":"publish","type":"post","link":"https:\/\/sierraexpressmedia.net\/?p=83904","title":{"rendered":"Reflections On 4th Parliament Of 2nd Republic Of Sierra Leone"},"content":{"rendered":"<p><strong>Thursday 7<sup>th<\/sup> of December, 2017<\/strong> was not an ordinary weekday. The day ushered in the ringing of a bell. The melody that accompanied it was signaling the end of a time. Indeed, the Fourth Parliament of the Second Republic of Sierra Leone was in the throes of its final breath. It was a moment that was emotional, sensational and reflective of the harsh realities of politics and power in Africa South of the Sahara. \u00a0(Photo: <em>By: Momodu-Lamin Deen Rogers, Clerk of Committees, Sierra Leone Parliament )<\/em><\/p>\n<p>At about 10am local time, the Clerk of Parliament, under the provision <strong>sub- section (1) of Section 85<\/strong> of the <strong><em>Constitution of Sierra Leone (Act No. 6 0f 1991),<\/em><\/strong> proclaimed the dissolution of the August Body. And His Excellency the President made his final and farewell speech, having served two (2) consecutive terms as President of the Republic.<\/p>\n<p>Moving away from the orgy of state craft and events of that day, it seemed that political power is at its best when it is used to serve humanity. Interestingly, Parliament is a different animal in the political power game and democratic governance. It is so because; Parliament is the birthplace of democracy and the citadel of the ultimate authority of the people.<\/p>\n<p>Having served as a senior legislative officer during this period under review, it became a moral obligation for me to share in brief, my experiences and thoughts on some of the core activities of the Fourth Parliament of the Second Republic.<\/p>\n<p>A better way to share these reflections on the Fourth Parliament is to give an account of the cardinal or traditional functions of Parliament during this period: Representation, Law &#8211; Making and Oversight. Each of these functions will be looked at from a constitutional and institutional perspective, incorporating the sum total of my experience, spanning almost a decade in this legislative environment.<\/p>\n<p><strong>REPRESENTATION:<\/strong><\/p>\n<p>The <strong><em>Constitution of Sierra Leone<\/em><\/strong> is very clear on the composition, roles and representative functions of Parliament. <strong>Subsections (1) &amp; (3) of Section 73<\/strong> respectively state that Parliament shall consist <em>\u201cthe President, the Speaker and Members of Parliament<strong>\u201d <\/strong><\/em>and that <em>\u201cParliament may make laws for the peace, security, order and good government of Sierra Leone.\u201d<\/em><\/p>\n<p>On representation, <strong>Section 97 (b)<\/strong> states: <em>\u201cAll Members of Parliament shall regard themselves as representatives of the people of Sierra Leone \u2026\u201d<\/em><\/p>\n<p>In fulfilling the above constitutional provisions, the Fourth Parliament of the Second Republic had a total of <strong>124<\/strong> Members of Parliament, of which <strong>112<\/strong> were ordinary members directly elected by constituencies and <strong>12<\/strong> Paramount Chief Members individually representing each of the then <strong>12<\/strong> administrative districts of Sierra Leone. The Fourth Parliament had only two <strong>(2)<\/strong> major political parties in the Chamber (<strong>All Peoples Congress &#8211; APC<\/strong> and <strong>Sierra Leone Peoples Party-SLPP<\/strong>). The <strong>APC<\/strong> had <strong>70<\/strong> elected members and the <strong>SLPP<\/strong> <strong>42<\/strong> elected members. The gender configuration at the end of the Fourth Parliament was <strong>16<\/strong> women and <strong>108<\/strong> men. Young adult representation was at a fairly encouraging <strong>32% <\/strong>or thereabout. At about the end of the Fourth Parliament, there was no youth representation because jocularly those who were elected as youth had already entered into the young adulthood or passed the youth age before the effluxion of time.<\/p>\n<p>The Fourth Parliament also saw its moments of grief caused by the loss of seven (7) of its Members at the wicked hands of death. The most shocking were those successive ones of Hon. Patrick Foyah and Hon. Mrs. Alice Foyah from <strong>Constituency 01<\/strong> in the Kailahun District. It was a situation of the husband succeeding the wife in <strong>Constituency 01<\/strong> but they both died successively before completion of the same term in the Fourth Parliament. The most touching and emotional one to me personally was the death of Hon. Augustine B. Torto, a Member I served as Clerk on the Foreign Affairs Committee, which he chaired for several years. There are also fond memories of Hon. Bliss Osho Williams, who was the Team Manager of the Parliamentary Football Team \u2013 a team that served as a comforting recreation for Members of Parliament. I still vividly recollect to date, the pound sterling notes he splashed for a brilliant goal, our provincial tours with the team and the issue of the <strong><em>\u201cmonkey <\/em>delicacy\u2019\u2019<\/strong>. I am very sure that these fond memories will remain for a long time in the minds of the erstwhile Deputy Speaker \u2013 Hon. Chernoh Bah, the then Chairman of the Sport Committee \u2013 Hon. Nuru Deen Sankoh-Yillah and the Team Captain then \u2013 Hon. Alpha B. Lewally.<\/p>\n<p>The hands of death still haunted the path of the Fourth Parliament; this time it was my <strong>\u201cEditor-in \u2013 Chief\u2019\u2019<\/strong>, Hon. Frank Kposowa who died in a gruesome road accident on the 11<sup>th<\/sup> January, 2018. The Member of Parliament had served two (2) successive terms representing his people from the then <strong>constituency 071. <\/strong>\u00a0. For almost ten (10) years, I worked with Hon. Frank Kposowa who edited and gave journalistic meaning to much of my writings in Parliament. A day before the accident that took his life, we discussed the first draft of this article and as usual he made few comments and suggestions to me. His soul will never be pleased if I do not use the word <strong>\u201csubterfuge\u201d <\/strong>when making reference to his memory<strong>. <\/strong>A word only Hon. KES Boyah, Hon. Dr. Bu-Buakei Jabbi and my humble self, understand better than the literal English meaning given to it. Until his death, our Parliamentary banter was \u201c<strong>subterfuge\u2019\u2019<\/strong> \u2013 that was how we greeted, initiated discussion and shared ideas.<\/p>\n<p>On the global stage, the Fourth Parliament had solid representation across the board and they did well in representing the people of Sierra Leone. We had some of the finest representatives in the following: the ECOWAS Parliament headed by the then Deputy Speaker \u2013 Hon. Chernoh Bah, the Pan African Parliament headed by the erstwhile Minority Leader, Hon. Dr. Bernadette Lahai; the African, Caribbean Pacific \u2013 European Union (ACP-EU) Parliament, headed by the then Majority Leader &#8211; Hon. Ibrahim Bundu; the Inter- Parliamentary Union (IPU), headed by Hon. Rosaline J. Smith, the Commonwealth Parliamentary Union (CPU) and a host of other global Parliamentary Associations. The Fourth Parliament was able to serve in critical positions in the above supranational Parliaments. Its then Minority Leader was elected \u00a0Vice &#8211; President of the Pan &#8211; African Parliament; and its then Majority Leader was also elected as President of the African Caribbean and Pacific (ACP) Parliamentary Assembly and Co-President of the ACP-EU Joint Parliamentary Association. What a feat!<\/p>\n<p>Notwithstanding the above achievements, parliamentary representation still remains a political concept that requires civic education at national level. Representation is a difficult political craftsmanship; and to this, political parties should add some more elements into awarding party labels to candidates in order to ease this difficult task from elected officials of the state. The nexus between constituents\u2019 expectations and the representative function of Members of Parliament remains inexhaustive. It is hoped that the Fifth Parliament will look at the representative functions of its members and the messaging around the whole concept, properly conveyed to the body of voters. The leading question in this national discourse shall be; <strong><em>WHO IS A MEMBER OF PARLIAMENT?<\/em><\/strong><\/p>\n<p><strong>LAW &#8211; MAKING:<\/strong><\/p>\n<p>Perhaps the most impactful function of Parliament is to make laws. No wonder why Lord Blackhall stated that <strong><em>\u201cParliament can do anything except turning a man into a woman\u201d. <\/em><\/strong>In fact, law &#8211; making can even do the exception in Lord Blackhall\u2019s assertion.\u00a0 J.S. Mill (1806-73) could not agree more with Lord Blackhall when he expounded his thoughts on parliamentary sovereignty which, in his words, connotes the principle of absolute and unlimited power.\u00a0 The <strong><em>Constitution of Sierra Leone (Act No.6 of 1991<\/em>) <\/strong>defines the location of supreme legislative powers in <strong><em>Section 105<\/em><\/strong> thus: \u201cParliament shall be the supreme legislative authority for Sierra Leone\u201d<\/p>\n<p>Law &#8211; making is a critical component of parliamentary function.\u00a0 In frequent usage nowadays, Members of Parliament are referred to as law &#8211; makers; and in some instances, law -making over-shadows the other equally important functions of Parliament.<\/p>\n<p>The Fourth Parliament had a fair share in its law &#8211; making mandate.\u00a0\u00a0 Law -making in a parliamentary environment is a disciplined practice and procedure; and it includes several elements.\u00a0 The <strong><em>Constitution<\/em><\/strong> and the <strong><em>Standing Orders<\/em><\/strong> of the Sierra Leone Parliament are very clear on the mandate of Parliament in law-making.\u00a0 The table below is indicative of the elements and the activities done by the Fourth Parliament of the Second Republic on Law &#8211; making:<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"43\"><strong>No<\/strong><\/td>\n<td width=\"312\"><strong>Elements<\/strong><\/td>\n<td width=\"174\"><strong>No of Activities<\/strong><\/td>\n<\/tr>\n<tr>\n<td width=\"43\">1<\/td>\n<td width=\"312\">Acts<\/td>\n<td width=\"174\">66<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">2<\/td>\n<td width=\"312\">Motions<\/td>\n<td width=\"174\">197<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">3<\/td>\n<td width=\"312\">Sittings<\/td>\n<td width=\"174\">304<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">4<\/td>\n<td width=\"312\">Papers Laid<\/td>\n<td width=\"174\">463<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">5<\/td>\n<td width=\"312\">Presidential Nominees<\/td>\n<td width=\"174\">493<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">6<\/td>\n<td width=\"312\">Ministerial Briefing<\/td>\n<td width=\"174\">7<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">7<\/td>\n<td width=\"312\">Ministerial Question Time<\/td>\n<td width=\"174\">3<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">8<\/td>\n<td width=\"312\">Standing Order 23 &#8211; Personal<\/p>\n<p>Explanation<\/td>\n<td width=\"174\">223<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><em>The above table is not exhaustive but it is a clear indication of the work of the Fourth Parliament<\/em><em>.<\/em><\/p>\n<p>Members of the Parliamentary Alumni will agree that the Fourth Parliament did what it was able to do given the circumstance, especially in the enactment of laws. Key among the<strong> 66<\/strong> Acts passed or amended by the Fourth Parliament was The <strong>Constitution of Sierra Leone (Amendment) Act, of 2013<\/strong> which speaks to the election of the Speaker and the Deputy Speaker of Parliament. Members of the Fourth Parliament saw the amendment of <strong>Sections 79 &amp; 80 <\/strong>of the Constitution as a declaration of parliamentary sovereignty and to a large extent an enhancement of the principles of Separation of Powers by allowing MPs to elect a Speaker and a Deputy Speaker from among them. I have the similar conviction as did the drafters of the <strong>1991 Constitution<\/strong> on the election of the Deputy Speaker. My conviction is that it is procedurally comforting to have the election of the Deputy Speaker in every session of Parliament, bearing in mind the role of the Deputy Speaker as an umpire in the House.<\/p>\n<p>However, the following areas should be under serious consideration for the Fifth Parliament:<\/p>\n<ul>\n<li>Promoting participatory law &#8211; making. The dividend of this in the Fourth Parliament was the 2016 \u201cAbortion Bill\u201d. It was a Bill that generated overwhelming public interest and engagement.\u00a0 The Bill never survived maturity into an Act because the Court of Public Opinion was against it.\u00a0\u00a0 In other words, the said Bill was guillotined,<\/li>\n<li>A thorough look at Standing Order 5(9) on parliamentary sittings,<\/li>\n<li>A pensive look at Standing Order 19, which speaks to Questions to Ministers and<\/li>\n<li>Expert and Civil Society partnership. This will enable Parliament to expand their reach and to ensure that voices that might not otherwise be heard are given the chance to contribute to the legislative process.<\/li>\n<\/ul>\n<p><strong>OVERSIGHT:<\/strong><\/p>\n<p>The intersection of representation and law &#8211; making is the Oversight function of Parliament.\u00a0 It is the caller calling to account. \u00a0\u00a0The generality of <strong>Sections 93, 94, 95 and 96 of the Constitution of Sierra Leone (Act No.6 of 1991)<\/strong> in tandem with <strong>Standing Orders 70 and 72, <\/strong>explain how oversight is conducted and outline the powers and privileges of Parliamentary Committees, which are the principal means of in Legislative Oversight.<\/p>\n<p>To effectively and efficiently carry out legislative duties, the Fourth Parliament had thirty &#8211; six (36) Parliamentary Committees.\u00a0 The newest of the Committees was the Parliamentary Committee on the Sustainable Development Goals (SDGs).\u00a0 Of course, the SDGs Committee had a wider responsibility. That explains why the Fourth Parliament wasted no time to have it instituted in the very last few months of its life.<\/p>\n<p>Oversight function in Parliament is an accountability mechanism which looks at issues of value \u2013for-money and the actual result or outcome for the people, especially the vulnerable group.<\/p>\n<p>Perhaps the foremost of such accountability mechanisms in Parliamentary oversight function is the Public Accounts Committee (PAC).\u00a0 The PAC of the Fourth Parliament made major strides; and the highpoint of it came up during the Auditor-General\u2019s mid-term audit report on the Ebola Funds.\u00a0 It was a new terrain for the PAC. But the oversight committee, with other accountability institutions of the State, was able to investigate the issues in the audit report and a report was submitted to the government. Other oversight committees performed equally and the Committees Department of Parliament which serves as the workshop of Parliamentary Oversight, laid on the table of the House, over <strong>100<\/strong> Committee Reports.<\/p>\n<p>The following should be cited as areas of consideration for the Fifth Parliament:<\/p>\n<ul>\n<li>Retool the systems and practices of oversight activities through capacity building of MPs and staff<\/li>\n<li>Timely provision of the necessary funding to enable oversight Committees deliver on their legislative mandate<\/li>\n<li>Revision of the Standing Orders of Parliament and recalibration of the <strong><em>modus operandi<\/em><\/strong> of oversight activities<\/li>\n<li>Constitute committees on government assurance and modernization \u2013 the committee on assurance will serve as constant oversight mechanism on government pronouncements and commitments on national development; whilst the modernization committee will serve as a reform or self assessment tool.<\/li>\n<\/ul>\n<p><strong>CONCLUSION<\/strong><\/p>\n<p>Parliament as the birthplace and the shrine of democracy has three (3) traditional but interrelated functions: to make law, to oversee the activities of the executive branch of government and to represent the interests of the people, as well as to ensure accountability, transparency and inclusion across State governance.<\/p>\n<p>The Fourth Parliament of the Second Republic made several strides to fulfill its core constitutional mandates to the people of Sierra Leone. There were challenges during the course of the journey; but those challenges were not insurmountable. The Assembly was able to uphold <strong>sub- section 3 of Section 73 of the Constitution of Sierra Leone (Act No.6 of 1991),<\/strong> which states: <strong><em>\u201cParliament may make laws for the peace, security, order and good government of Sierra Leone\u201d.<\/em><\/strong><\/p>\n<p>The legacy of the Fourth Parliament like all other Parliaments so far in the Second Republic, is enduring.
