{"id":51854,"date":"2013-01-15T08:00:04","date_gmt":"2013-01-15T08:00:04","guid":{"rendered":"http:\/\/www.sierraexpressmedia.com\/?p=51854"},"modified":"2013-01-15T08:00:04","modified_gmt":"2013-01-15T08:00:04","slug":"attempt-to-discredit-apc-ukni-branch","status":"publish","type":"post","link":"https:\/\/sierraexpressmedia.net\/?p=51854","title":{"rendered":"Attempt to discredit APC UK\/NI Branch"},"content":{"rendered":"<p style=\"text-align: justify;\">The attention of the Leadership of the All People&#8217;s Congress (APC) United Kingdom\/Northern Ireland Branch has been drawn to the disturbing news in which a group of individuals attempted to discredit the executive of the Branch.<\/p>\n<p style=\"text-align: justify;\">This follows a meeting organised by the said group at the Methodist Church in London in which they came up with illegitimate resolutions aimed at not only discrediting the Executive headed by Chairlady Kumba Momoh, but also aimed at causing unnecessary confusion within the APC UK Branch.<\/p>\n<p style=\"text-align: justify;\">The Leadership of the APC UK Branch would like it to be known that the dust raised from the 2012 Presidential and General Elections in Sierra Leone is yet to settle down and that the current situation is not healthy for such unfortunate development.<\/p>\n<p style=\"text-align: justify;\">Chairlady of the branch, Kumba Momoh, who has been in Sierra Leone since the November 2012 elections, is therefore calling on all members of the Branch to remain calm and work towards the general good of the party.<\/p>\n<p style=\"text-align: justify;\">Momoh also warns the organisers of such meetings to desist from such illegal meetings and engage themselves in programmes aimed at boosting the President&#8217;s Agenda for Prosperity programme.<\/p>\n<p style=\"text-align: justify;\">The Leadership of the Branch has already sent a formal complaint to the party&#8217;s headquarters in Freetown and appropriate action will be taken against law breakers.<\/p>\n<p style=\"text-align: justify;\">SEE BELOW FOR LETTER OF COMPLAINT<\/p>\n<blockquote>\n<address style=\"text-align: justify;\">Hon Victor Bockarie Foe<\/address>\n<address style=\"text-align: justify;\">The APC National Secretary General<\/address>\n<address style=\"text-align: justify;\">APC Headquarter<\/address>\n<address style=\"text-align: justify;\">Old Railway Line<\/address>\n<address style=\"text-align: justify;\">Freetown<\/address>\n<p style=\"text-align: justify;\">Sierra Leone<\/p>\n<p style=\"text-align: justify;\">Dear\u00a0Mr. Secretary General<\/p>\n<p style=\"text-align: justify;\"><strong>A REQUISITION TO SUSPEND THE APC UK &amp; NORTHERN IRELAND BRANCH<\/strong><\/p>\n<p style=\"text-align: justify;\">This a letter of complaint brought under the collective umbrella of aggrieved executive members of the APC UK &amp; Northern Ireland Branch. This letter will serve as\u00a0one of the\u00a0effective mediums\u00a0for communicating our concerns\u00a0over the recent contravention of our Bye-Laws\u00a0by some members of our executive. The\u00a0acts were disgraceful to say the least.<\/p>\n<p style=\"text-align: justify;\">We\u00a0therefore\u00a0ask\u00a0that the\u00a0National Executive Council of our prudent\u00a0Political Partyin Sierra Leone through your\u00a0respectable\u00a0office\u00a0intervene by suspending our Branch forthwith until further notice.<\/p>\n<p style=\"text-align: justify;\"><strong>The Basic facts<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li>On 13<sup>th<\/sup>\u00a0January 2013 a General Meeting\u00a0of our branch was summoned\u00a0by three members of our executive, namely, Tamba Opel Samsumana, Dr Seray Wurie and Abubakarr Kamara (Bakadies)\u00a0in contravention of our bye-laws, which is the\u00a0principal instrument by which the Branch is governed,\u00a0and it is subordinate to our APC National\u00a0Constitution.<\/li>\n<li>The meeting took place\u00a0at a Methodist Church in London. The\u00a0purpose of the meeting was for the trio to inform the general members\u00a0at the meeting\u00a0about their newly appointed\u00a0executive\u00a0members, of which Tamba Opel Samsumana is the Chairman\u00a0and Abu Bakarr Kamara, Vice Chairman,\u00a0and that MrsKumba Momoh\u2019s (Chairman) term of office\u00a0had\u00a0lapsed since December 2012.<\/li>\n<li>It was duly noted that majority of the\u00a0members\u00a0at the meeting\u00a0were wilfully misinformed, and no opportunities were given to prudent members of the branch to challenge\u00a0or rebut\u00a0the false statements.\u00a0It was a collective mass of junk being fostered to the public.<\/li>\n<li>It is incumbent upon us to inform you that the reigning Chair, Mrs Alice Kumba Momoh\u00a0won the election on 7<sup>th<\/sup>\u00a0March 2010, and should act in the capacity for 3 years. So her term of office will therefore lapse\u00a0on 6<sup>th<\/sup>\u00a0March 2013.\u00a0The argument propounded by\u00a0Dr Seray Wurie and Tamba Opel Samsumuna was that the election which took place in March 2010, should have taken place in December 2009, but because modalities were not in place they had to postponed the election to March 2010, thus\u00a0the effective\u00a0date of the\u00a0\u20183 years term\u2019\u00a0commenced from\u00a0December 2009.\u00a0How could this be possible when the effective\u00a0date of the \u2018three years\u00a0term\u2019\u00a0is the date\u00a0the election took place in 2010,\u00a0not\u00a0December 2009 when the\u00a0election should have\u00a0allegedly\u00a0taken place?\u00a0It is therefore submitted that Mrs Kumba\u2019s term of office will expire in approximately 2 months.\u00a0And we still thereforerecognise her as our outgoing Chair person.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>The Laws<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li>At the time of the meeting when Dr Wurie assumed the\u00a0office of an interimChairman of the Branch,\u00a0The Vice Chairman, Mr Makki Shek was present, and he should have\u00a0been given the absolute right and privilege\u00a0to Chair the said meeting\u00a0in the absence of the Chair\u00a0person as stipulated in\u00a0our Bye-Laws.\u00a0<strong><span style=\"text-decoration: underline;\">Article 3.1(a)(ii)<\/span><\/strong>\u00a0clearly states that\u00a0\u201c<em>The chairman shall preside at all meetings at which he or she is present. In the absence of the Chairman, the Vice Chairman shall so preside, and in the absence of both, the Branch Secretary shall preside or call on those present in good standing to elect one of their numbers to preside at the meeting, subject to the proviso that if\u00a0the Chairman or Vice Chairman arrives after the Branch Secretary has chosen, or any member has been appointed, to preside in the Chair or Vice Chair\u2019s place, then the Chair or Vice Chair\u00a0<\/em>\u00a0in\u00a0<em>the absence of the Chair,<\/em>\u00a0<em>may assume if either so wishes, the right to preside at the meeting on the conclusion of the item of business under consideration at the time of the arrival of the chair or the Vice Chair\u201d.<\/em><\/li>\n<li>In\u00a0the imminent\u00a0realisation of the material breach\u00a0of our Bye-Laws, the Legal Advisor, the Oxford and Reading Region Secretary, The Communication Director, the Financial Secretary, The Vice Chair and one Mr. Munu all rising to a\u00a0<strong>\u2018Point of Order\u2019<\/strong>, in accordance with\u00a0<strong>Article 3.1(b)(vi)(iii)\u00a0of the Bye-Laws,<\/strong>\u00a0which states that\u00a0<em>\u201c any purported breach or question relating to these Bye-Laws may be raised by a member rising to a \u2018point of order\u2019. The Chair\u2019s ruling on any point arising from the Bye-Laws is final unless challenged by not less than four members; such a challenge shall be put to the meeting without discussion and shall only be carried with support of two thirds majority of the members present at that meeting in line with the Bye-Laws\u201d.\u00a0<\/em>Dr Wurie deliberately ignored the fundamental rights of the aforementioned members.\u00a0Tamba Opel Samsumana and Dr. Wurie subsequently summoned Police to the meeting for an unfounded allegation of breach of the peace. When the Police attended the scene,\u00a0they kindly asked the\u00a0said\u00a0members to leave the building, which they so did.<\/li>\n<li>Furthermore, Tamba Opel Samsumana stated in the meeting that Dr Wurie\u2019s mandate to act as interim Chairman derives from the Bye-Laws,\u00a0by\u00a0asserting that\u00a0<strong>Article 4.1(d)(ii)<\/strong>\u00a0gives the interim Chairman the power to dissolve\u00a0theexecutive without seeking any consultation\u00a0or call for an executive meeting.Some\u00a0members at the meeting were notably amazed and disappointed by the conducts\u00a0and assertions\u00a0of the three culprits. It is an acceptable assertion for one to suggest that\u00a0Mr. Samsumana\u00a0is well known for committing offences ofthese magnitudes.\u00a0He is\u00a0also\u00a0notable for falsifying\u00a0information. There is no such provision in the\u00a0Bye-Laws. He purposely created the provision with a view to deceiving the members at the meeting.<\/li>\n<li>It is\u00a0further\u00a0evident that Tamba Opel Samsumana has now formed a 60 man executive prior to the forthcoming election. The names of each member were pronounced in the meeting and have all agreed to work in his administration with Dr Wurie being given the title\u00a0\u2018The Ayatollah\u2019 of the Branch.\u00a0It is alsoevident that certain members of Tamba\u2019s executives have\u00a0been appointed as electoral commissioners.<\/li>\n<li>Our position has been explicitly communicated\u00a0at the meeting that we will not take part in Tamba Opel Samsumana\u2019s administration, as they are not fit for purpose. We will work in an administration that clearly reflects the will of the people in the spirit of democracy. Power should not be taken by force. It is God\u2019s appointment and must be done in accordance with the letters of the law and the consensual wish of the people.\u00a0Every member of the branch must accept and abide by the provisions of our instrument, and other lawful rules, regulations, directives and decisions of the Branch and the Constitution of the APC Party.<\/li>\n<li>In light of the above, we respectfully submit that all activities of the Branchmust\u00a0be suspended forthwith\u00a0in the interest of the Branch and our politicalParty\u00a0in Sierra Leone, and\u00a0Tamaba Opel Samsumana (The brother of the Vice President), Dr Seray Wurie and Abu Bakarr Kamara (Bakkadies) be punished severely by the National Executive Council of the All People\u2019s Congress in Sierra Leone\u00a0for this offence of treason.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">In the interim, should there be any queries, please do not hesitate to contact our Chair, Mrs Alice Kumba Momoh who is presently in Sierra Leone.
